Motion to Dismiss Lawsuit

In the lawsuit, a woman accused Combs of drugging and raping her when she was a student at Syracuse University in 1991. Legal documents obtained by PEOPLE and filed by Combs’ attorneys on Friday, April 26, claim that some of the allegations “were brought under statutes that did not exist at the time the alleged misconduct occurred.”

Specifically, the filing argues that revenge porn and human trafficking are among the claims that should be dismissed with prejudice, as the laws surrounding them did not exist when Joi Dickerson-Neal alleged Diddy sexually assaulted her in 1991.

Combs has previously denied the claims, alleging that Dickerson-Neal fabricated the story.

According to the lawsuit filed in November 2023, Dickerson-Neal claimed Combs took her to dinner at a Harlem restaurant in January 1991, drove her to a recording studio, and allegedly drugged her, “resulting in her being in a physical state where she could not independently stand or walk.” Combs then allegedly sexually assaulted her, filming the incident, which was later shared within the music industry.

The lawsuit also named Bad Boy Entertainment, Bad Boy Records, and Combs Enterprises as defendants. However, Combs’ legal team argues in the filing that these claims should be dismissed as well, as these companies were not in existence at the time of the alleged incident.

The filing comes amid other sexual assault allegations against Combs, with five people filing separate lawsuits against him in recent months, all of which he has denied. One lawsuit has been settled.

Combs’ attorney, Aaron Dyer, referred to the recent raids on Combs’ homes as a “gross overuse of military-level force” and labeled them a “witch hunt based on meritless accusations made in civil lawsuits.”
